Uhhh I am not trying to be smart ass here but...FSS 934.03 is about wire intercepts. The guy doing the interview brings this up as if she has intercepted an electronic oral conversation. Did the meeting between her and her supervisors take place over a telephone or skpe or something? If it is illegal to record a conversation without the other person's permission then we have a big problem on youtube and facebook. Get your pens out and starting charging people. I am starting to worry about the investigator's training and the detective's training also. Perhaps the statute should be examined closer.
First let's look at the definitions----
934.02 Definitions.—As used in this chapter:
(1) “Wire communication” means any aural transfer made in whole or in part through the use of facilities for the transmission of communications by the aid of wire, cable, or other like connection between the point of origin and the point of reception including the use of such connection in a switching station furnished or operated by any person engaged in providing or operating such facilities for the transmission of intrastate, interstate, or foreign communications or communications affecting intrastate, interstate, or foreign commerce.
(2) “Oral communication” means any oral communication uttered by a person exhibiting an expectation that such communication is not subject to interception under circumstances justifying such expectation and does not mean any public oral communication uttered at a public meeting or any electronic communication.

Question 1-What are the circumstances justifying the "expectation of privacy?" Not policy wise state law wise. Three people in a meeting in a public building...is that really wire intercept? Good luck down at the SAO with that.

Now let's look at the actual crime----

934.03 Interception and disclosure of wire, oral, or electronic communications prohibited.—
(1) Except as otherwise specifically provided in this chapter, any person who:
(a) Intentionally intercepts, endeavors to intercept, or procures any other person to intercept or endeavor to intercept any wire, oral, or electronic communication;
(b) Intentionally uses, endeavors to use, or procures any other person to use or endeavor to use any electronic, mechanical, or other device to intercept any oral communication when:
1. Such device is affixed to, or otherwise transmits a signal through, a wire, cable, or other like connection used in wire communication; or
2. Such device transmits communications by radio or interferes with the transmission of such communication;
(c) Intentionally discloses, or endeavors to disclose, to any other person the contents of any wire, oral, or electronic communication, knowing or having reason to know that the information was obtained through the interception of a wire, oral, or electronic communication in violation of this subsection;

You guys scare me. I want to know what this HB's background is, what his education ( I hope undergrad at minimum) level is and how much training in regards to state law he has received.

For all of that are facing an IA investigator remember one thing. If they ask you if you are familiar with a certain law or statute or policy insinuating that you might have violated said law or policy tell them "no" you are not 100% sure and then ask them to explain the state law or policy to you in detail on record. Then ask them to simplify the law in terms that a reasonable person would understand. Put it back on him. Never admit to knowing a law or policy 100%. Always tell them that you are unclear on the intent of the law or policy and ask them to advise you on the "intent" of the law or policy. This is not legal advice this is just advice. Thanks Andrew for bringing Bettina's harrowing experience to light. Listening to H.B.s intererrogation of Bettina was minipulative.

If Bettina would have not used the word investigation and instead said something like I wanted to bring attention to possible wrong doing about Nikki falsifying her time sheets she may have beat that charge of investigating a fellow employee with out the sheriffs authorization. and of course Jason knew Bettina hit the record button on her phone, she made it obvious.

I would like to hear more about the circumstances of nikki and casserela getting caught together in the training center. was it during working hours?'
