Tennessee v. Garner - 471 U.S. 1 (1985) put a stop to shooting at unarmed fleeing felons; here is the critical excerpt from the decision: (c) While burglary is a serious crime; the officer in this case could not reasonably have believed that the suspect -- young, slight, and unarmed -- posed any threat. Nor does the fact that an unarmed suspect has broken into a dwelling at night automatically means he is dangerous. Pp. 471 U. S. 20-22.

Subsequently, in Graham v. Connor, 490 U.S. 386 (1989) the United States Supreme Court was more pragmatic, establishing that . . . (c) The Fourth Amendment "reasonableness" inquiry is whether the officers' actions are "objectively reasonable" in light of the facts and circumstances confronting them, without regard to their underlying intent or motivation. The "reasonableness" of a particular use of force must be judged from the perspective of a reasonable officer on the scene, and its calculus must embody an allowance for the fact that police officers are often forced to make split-second decisions about the amount of force necessary in a particular situation. Pp. 490 U. S. 396-397.

Chief Headley’s, December 1967 pugnacious utterance may have had a “Dirty Harry” resonance, but they were outlandish then and remain so today. Police use of deadly force is the last recourse; applied only when our lives and that of innocent victims are in mortal danger. Anything else is false bravado.

Moral of the post? Do not shoot at looters fleeing from you.

Bravo, I could not have illustrated the problem in this country any better than that.
If you ever wonder why this country is headed towards a manure pile at hype sonic speed just read the above post.
The liberals have created an environment where there is no respect for the law as there are no consequences for violating them. Criminal operate on a principal of risk Vs reward. The liberal courts have remove all the risk for these animals and they will continue with their criminal rampage while we look on afraid to act and be the ones that get in trouble. The public and the property owners need to take up arms and protect what is theirs; we obviously are not allowed to do it.

I worked thru Andrew. They were looting the stores DURING the storm! After the storm, it was like the wild west. Everybody and their brother was carrying guns down the streets. The roads were all blocked by telephone poles and trees. They assigned national guard units to us and I swear the first couple weeks I arrested AT LEAST 10 people a day for curfew violations (if you didn't they would be stealing anything that wasn't tied down). It was simple form, not even an A-form. No OI. We filled up every 39 van the county had. It was the only way to keep the savages at bay. But remember, Andrew primarily took out Kendall and south. The North end was relatively ok. If a storm were to hit north dade, I hate to imagine the chaos that would ensue. Take care of your families first, then each other and LAST THE DEPARTMENT AND PUBLIC!
