    Knight's PC v. Proof Beyond a Reasonable Doubt

    Personal political favors will only go so far with the 12th Judicial Circuit. That means that the buck stops with Ed Brodsky at the SAO. Knight’s contrived probable cause (PC) may stop with Brodsky. Here are basic elements in the criminal justice system:

    • ARREST: Knight needs to develop PC to legally arrest Bybee. If the PC is bogus or contrived or not valid, then Knight can worry about that later because it’s up to Bybee to prove that he is not guilty.
    • PROSECUTION: Brodsky needs “proof beyond a reasonable doubt” to proceed forward with a criminal court case against Bybee.

    At the Sarasota Sheriff’s Office, Knight can order his executive-level henchmen to contrive criminal PC from a ridiculous civil case. However, to do that, Knight will have to develop his PC based on the testimony of an unstable citizen who has already:
    1. contradicted herself multiple times
    2. both in writing and in voice audio.
    Knight has access to this information (it was already in the newspaper in Tom Lyons article). However, the SAO cannot prosecute Bybee, based exclusively on contradictory testimony. The SAO needs evidence that is “proof beyond a reasonable doubt.” Contradictory testimony falls way short of that. That may put Knight in a legal pickle.

    However, if Knight is looking to “frame up” Bybee (since Bybee sued Knight and subsequently embarrassed him), then Knight has to rely on the woman’s contradictory testimony as PC to arrest Bybee. Important questions a good investigator will ask include:
    1. Which time is she telling the truth?
    2. Which of her contradictory versions of the story is the truth?

    Knight can selectively order his executive henchmen to document in the “probable cause affidavit” only the versions that will authorize Knight to have Bybee arrested (aka to “frame up” Bybee with multiple stacked-up charges?) – but in order to do that, Knight must disregard the contradictory testimony of the woman because her contradictory testimony establishes her as being either:
    1. unreliable (if she is mentally unstable)
    2. or untruthful (if she is angry).
    3. or both (angry and mentally unstable).

    Knight apparently believed that her contradictory testimony was solid enough for him to announce during a televised conference that “Bybee is guilty of heinous crimes.” Knight’s contrived PC is not going to be enough to establish “proof beyond a reasonable doubt” for the SAO to proceed forward with the case against Bybee in court. And Brodsky knows that. How far out on a limb will Brodsky go to protect Knight’s political and legal reputation? Definitive answers are coming soon.

    What is the woman's name that he was having an affair with? Is that public record? When will her name be released? Did she know about the other elderly lady?

    It's Go Fund Me not go find me my friend, we don't need to go find Bybee, we know exactly where he is.

    With that said, I won't lie, at the onset I thought he was most likely guilty as sin, but my conviction started to waffle upon reading all the evidence that was available. But now, after reading the full affidavit, combined with the newly presented information as to him being a male escort, it doesn't look good for him.

    I grew up in the town next to Salem Ma. and know full well that hysteria and complicities' often find innocent people at the end of a rope. I try very hard to not prejudge until all the facts are on the table.

    A case like this is not normal, and the lawsuit made me start to think that there was a chance he was framed, using a bat shit elderly lady as the means to silence and possibly frame Bybee, but in retrospect, IMHO, there is very little chance that Mr Baybee is innocent. I do think due to the fact that Sherrif Knight should have stayed in the shadows and not parade Bybee around, that was unprofessional and the impotence of my doubt.

    For the record, He's not guilty of anything until he's convicted. But I don't think a jury of any peers will convene for long before his guilt is pronounced.

    PS I do feel bad for Bybees children, this cannot be easy for them. Hearing that your dad is a gigolo and a criminal and all...Sarasota's a small city, nowhere to hide. It's to bad this cop couldn't stay on the straight and narrow. Can only imagine the litigation for all the persons his testimony convicted. Every one of them not corroborated by another officer is surely starting their appeal.

    It would have been an airtight case, if Knight had not gotten involved. Knight almost blew this case. Bybee may be a criminal, but Knight remains what he's always been -- and it's not good for Sarasota County, nor for deputies.

    Bet all the people that donated are feeling dumb now... Wonder if his Wife stays after the newest info was brought to light he was moonlighting as a gigolo?? I feel terrible for his family, those poor kids have to hear the constant jabs from their classmates and have to grow up knowing the man they looked upto is a criminal... Damn shame
