former Police Chief Orlando Martinez, who sued the city, is now reportedly asking for a whopping 2.7 million dollars to settle several of his cases! And that’s just to take care of some of them and we’re not quite sure if that even includes attorney fees.
One thing for sure is that the city is spending a whole pile of “green” to defend itself against the former Chief who sued for breach of his 5-year contract, which was championed by the mayor at the time, which was Phil Stoddard and supported by a majority of the commission.
At the time of the Chief’s firing, it looked liked the city could not cite a probable cause to terminate the former chief’s contract, so City Attorney Pepe, opined that firing Martinez based on his temporary assignment as acting city manager while the manager was on leave, “constituted a breach” of his contract. During his tenure, the former chief had served as “acting city manager” approximately nine times yet, Mr. Pepe did not object nor “ Ring any bells.” Not surprisingly the city lost the case and now have to mediate the “green” part.
Adding insult to injury, the former chief also filed a malpractice lawsuit against Mr. Pepe, alleging that it was his job to protect both the former chief and the city in the first place, by advising both parties, that, serving as the acting city manager, “constituted a breach” in his contract with the city.
In addition, records show that the former chief has also sued the city for HIPPA violations due to Commissioner Welsh’s public discussion of his medical records. Along with these lawsuits, Martinez has sued Mayor Phil Stoddard personally for slander. Though not a part of these proceedings, records also show that a second individual has also filed a personal slander lawsuit against the mayor.

FIGHT IN A BAR
The night of Aug. 9, 2012, Aguiar, off-duty and in plain clothes, allegedly tried to detain two women at a bar for throwing a drink at a member of his party, in a dispute over certain outdoor seating. According to a complaint filed against him, Aguiar grabbed one woman by the arm and pulled another by the hair, ordering them not to leave. He called South Miami police. All the while, according to the complaint, he did not identify himself as a police officer.
When a bystander, Martin Lopez, tried to intervene, he alleged Aguiar punched him to the floor and kept swinging, hitting him repeatedly. Aguiar said the attack was a case of self-defense because Lopez came at him with a beer bottle. Multiple witnesses, when asked, denied seeing Lopez with a beer bottle. After the police arrived, Aguiar stood outside with his uniformed colleagues and advised Lopez, who required stitches in his lip, not to make a big deal of the incident, Lopez recalled in his complaint. The case was sent to the Florida Department of Law Enforcement, which cited a lack of evidence and did not press charges. That made it an administrative matter for the department. In April 2014, while the internal affairs case was still pending, Aguiar was promoted to lieutenant.
Landa, in his 2014 review, wrote, “I have had the honor of being in the law enforcement field for over 34 years, and Sgt. Jesus Aguiar is one of the most competent and dedicated professional police officer that I have had the honor and pleasure to work with.”
Since then, Aguiar has again come to the attention of internal affairs after an episode at a Cheesecake Factory in which his fiancee’s cousin — a convicted felon — started a disturbance by allegedly attacking another patron. Aguiar was there as the disturbance started, but left before Miami-Dade police arrived to arrest and charge the cousin with battery. Aguiar’s girlfriend, who is not a cop, allegedly flashed a badge at mall security officers before police arrived, saying the situation was under control and there was no need for law enforcement. http://www.miamiherald.com/news/loca...e45748940.html

Fired South Miami chief wins $434,732 judgment against city
South Miami Police Chief Orlando Martinez de Castro was fired by the city in 2013
He sued immediately after and this week a Miami-Dade judge awareded him $434,731.85
On Monday, Circuit Judge Jose M. Rodriguez returned a verdict of $434,731.85. The final verdict is expected to be signed this week. The judge also granted entitlement to attorney’s fees, a number that will exceed $200,000.
