    Florida Corrections Continues Terminations For Inappropriate And Criminal Behavior

    Friday, the Florida Department of Corrections announced that .......in addition....... to the six members of its staff that were terminated Thursday, this week an additional seven were dismissed under the DOC’s new employee discipline policy.

    Five employees of Lancaster Correctional Institution — Officer Earl Short, Officer Stephen Nygard, Officer Julious Riley, Sergeant Robert La Puma, and Sergeant Brittain Williams — were dismissed for battery on an inmate.

    Officer Houston Biddle of Okaloosa Correctional Institution was dismissed for a DUI arrest and..... Officer Glen Gordon of Desoto was dismissed for an arrest for operating a motor vehicle with a .....suspended/cancelled/revoked driver’s license.

    Last week DOC announced a strict zero-tolerance policy for employee misconduct and DOC Secretary Mike Crews sent a memo to all employees. DOC employees who commit a criminal act will immediately be placed on administrative leave and the Department will initiate disciplinary action for their dismissal.

    “The action we have taken this week makes it clear that we will not tolerate inappropriate behavior or criminal activity by our staff. Our staff should be held to the highest standards, and the zero-tolerance policy that we have put in place ensures that anyone who fails to do the right thing will no longer work for this agency. We value our culture of professionalism and integrity, and we will not let the bad actions of a few undermine and tarnish the reputations of all the hard working men and women in our department. Enforcement of our new discipline policy is a critical step in ensuring that happens,” Crews said in a written statement.

    Much of what's proscribed by his memo was already illegal. Inmate abuse or failure to report it, filing false reports, sexual misconduct, letting an inmate escape, smuggling any kind of booze or illegal drugs, taking bribes or bringing weapons into a prison are all mentioned in his memo. So is smuggling in cell phones, money or any "recorded communication" for inmates.

    But several off-duty offenses, misdemeanors, are also cause for firing now. Drunk driving, theft and domestic violence, for instance. Those might have nothing to do with a state employee's ability to do a job, but they're all covered by the tough new policy.

    You can't really argue that some level of malfeasance should be acceptable, especially in a department that exists to punish illegality. But a local lawyer who defends a lot of state employees in personnel disputes believes the DOC policy is draconian.

    Jim Garrity said he has had several phone calls from DOC employees who worry about getting fired for off-duty troubles that would go unnoticed anywhere else. And he said the policy can be applied unevenly — a DUI suspect who's liked by the boss gets sent to rehab while another, not so well-liked, gets the axe.

    "It raises a significant degree of concern among state employees, because it applies as much to the receptionist at headquarters as it does to the correctional officers guarding Death Row," Garrity, who blogs about personnel law, said in an interview last week.

    "As written, Crews' extremist policy applies even if you haven't been arrested, charged or convicted. It only requires conduct that 'violates any criminal statute,'" he wrote in his blog.

    Common sense would indicate they're not going to fire a good, long-serving employee for jaywalking or parking in a loading zone. Pot smoking or wife beating is something else, though, and can't be tolerated in an agency that has police powers — and a history of winking at boys being boys.

    Like any lawyer, Garrity sees worst-case scenarios, what they call a "parade of horribles" in the Legislature. Overdraw your checking account at the grocery store, drop a scrap of litter on the sidewalk, or put your heart pills one of those little travel containers without carrying your prescription, and you've violated a Florida law, he said. Even "rude but harmless disorderly conduct at a football game or party" could get a DOC employee fired, Garrity wrote in his online essay.

    You don't even need to get caught or arrested — a friend's tales of your weekend revelry might get back to the boss. That hard-partying photo you posted on Facebook might have seemed like a good idea at the time, but Monday morning? Not so much.

    "Perhaps it will soon be followed by a clarification that narrows the preposterously broad scope of this policy; for now, DOC employees should be cautious," Garrity said of the department memo. "It's the official policy of the agency, effective immediately. Bosses with malice in their hearts now have a new tool to go after their targets in the workplace."

    FDLE agents posing as inmates need to investigate and then criminally charge all female staff engaging in sexual misconduct with inmates. Don't just suspend or move them or allow them to resign without punishment. It's not hard to figure out when and where it's happening. The snitches and other staff know. Get these people off the compounds before they are pressed into other criminal acts. You'll have a safer prison...now there's a thought!

    these officers beat the shit out of me so many times. Ive seen them beat other inmates damn near to death
