You would care if he locked you up and you were not DUI by a trooper that was gunning for deputy. His sick plan backfired in his face.

According to the Tampa Bay Times, the State Attorney's Office cited a lack of evidence and conflicting witness accounts in deciding not to go forward with the case against Deputy Joseph Tibor.

A Florida Highway Patrol trooper pulled over a white Mercedes sedan Tibor was driving on State Road 50 west of Brooksville on Jan. 12. The Mercedes was going 85 mph in a 55 mph zone, trooper Cpl. David Fye wrote.

According to Frye's report, Tibor, 45, flashed his badge and had trouble finding his license in his wallet. He had glassy, bloodshot eyes, and his breath smelled of alcohol.

Tibor then failed sobriety tests, according to the report, and was arrested. He refused to give a breath sample at the Hernando County Detention Center.

Sounds like a good arrest. If he wasn't drunk, why did he refuse breath test????

    From the BN9 web:

I have no dog in this situation and know neither of the principles. And, forget the fact that Fye, depending on who else was present at the scene, could have called a friend of Tibor's at the very start of the stop to give him a ride home. The SA has made himself look really stupid by indicating there was a lack of evidence to go ahead with the prosecution. BS.

There was plenty of evidence for proceeding with the charges. It might not have been a conviction, but there seems to be plenty of evidence to go forward. Some folks might say the SA got, what looks like, PAID OFF. IF the deputy was sure he was not over the limit, why'd he not take a BAC? There's plenty of evidence. Sure looks like there no sack on the SA, or he got something in return.

Time for FHP in that SA district to begin providing only the absolute minimums to the SAO for all future criminal cases until there is a new SA in office who doesn't give signs that he might be taking "care" of friends, and has a personal vendetta against FHP. Looks very suspicious up there.

And, there is always the possibility that if the deputy doesn't get some help with his drinking, the next thing we may read is that he killed someone while sig. 1, since he "got away with it this time." And, who knows how many other times his "star" got him off. Let's hope the SO does some deep digging with this "deputy" prior to allowing him to continue to arrest members of the public.

    Re: Trooper Frye

Many "no blow" dui arrests across the state are not processed. I don't think this particular case was treated any different. Bottom line is he lost his license for a year regardless. So much for the job.

Ridiculous case law coupled with the state attorneys incompetence makes it a little harder these days.

    Re: Trooper Frye

His several years of saying he wanted to catch a cop makes it suspect.

I've had no blow convictions but what hurt this troopers case was his credibility from saying he wants to catch a cop, no in car video, no breath test room video, an independent civilian witness saying he didn't appear drunk.

Anyone can say someone was speeding and anyone can say some admitted to drinking.

So he should learn to shut his mouth about who he wants to burn.
Maybe he was drinking but trooper screwed case up

His refusal to blow says it all. He was drunk as a skunk.

SAO cut him a break that he didn't deserve. Dirty politics.
