    Time to unionize

    Are you tired of a hostile work environment, poor benefits, and unfair labor practices?

    Why should you not be compensated for working overtime, have no recourse for disciplinary action, and be subject to a discriminatory policing philosophy?

    Did you know that a Sergeant from SPD was just involved in a serious near death traffic accident and while awaiting surgery in the ICU he was worrying about if he was going to loose his job after 90 days...

    The time has come for action... They will tell you that a union has no power to negotiate collective bargaining with the Tribe. What they won't tell you is that as soon as 51% of the agency joins a union, you are no longer considered an at will employee. When 51% of the organization is represented by a labor union, you are legally considered gainfully employed and enjoy all the rewards and protections associated with it.

    Did you know that a union offers you:
    Disciplinary Action Representation
    Shooting Scene Representation
    Lawyers for civil / criminal actions arising from your duties as a law enforcement officer.
    Included death and disability insurance
    Collective Bargaining and negotiating better pay, better treatment, and a better retirement plan.

    They will tell you that the Tribe will not negotiate with a labor union. What they won't tell you is that the Florida's largest police union has over 30,000 members in Florida alone, and has one of the strongest lobbyist in Tallahassee with resources, influence, and connections to block gaming legislation. What's worth more to a candidate, an endorsement by the Police Union or the maximum election campaign contribution the Tribe can make of $1,000. What's a better headline. Tribe writes a 1k check to buy a gaming vote or candidate receives endorsement from the Police Union.

    They will threatened you that if you talk about a union at work or try to recruit members while at work you will be fired. They are right. Do not discuss at work and do not solicit officers to join at work.

    The technology age we are in gives us the benefit of joining. Union on line. No need to mail the application in or give it to a union rep and run the risk of the wrong person finding out you joined. Soon and very soon you will revive notification and instructions on a web site to go to so you can submit your police union application online. There is no way command staff and interfere with this process. You are safe.

    After we get a majority of the agency on board the police union will begin negotiations with the aTribe.

    It will work like this
    Soon you will have the option to sign up
    Once we get a majority, the Police Union Rep will go to the tribe and announce that a majority of the police officers at SPD work for the Tribe but now listen to him. He will represent us.
    Strength is in numbers. They will be resistant at first. But with 15 officers in the past 2 months leaving they will have no choice but to listen. They can not afford a work stoppage.

    Fellow SPD Officers,

    The time has come to take action. Please stand with your fellow SPD officers and join the Police Benevolent Association. We have 31 committed officer s that are ready to fight for better benefits and better treatment. You should not have to put a gun, a badge, and a bullet proof vest on everyday and come to work in a hostile environment. Once we get 60 committed officers we are going to hold general elections to nominate a Department wide representative and an alternate. With so many of our brethren leaving because of the mistreatment, we need to prepare to protect ourselves now against mandatory shift work compensated for in flex time. Our representative will work closely with legal counsel and negotiators from the PBA to negotiate better benefits from the Tribe. In the very near future, all SPD PBA members will be voting on their confidence level in our police chief, those results are going to be sent directly to each Council member, Board member, the President, The Chairman, the Human Resources Director, and the Sun-Sentinel, the Miami Herald, the News-Press, and the Tampa Bay Times. Our address to the Tribe’s government and to the local newspapers will also address our concerns. Please see any member to address your concerns so they can be heard in the letter.

    You have the ability to be part of something meaningful. To do something others couldn't accomplish. Why do we not have a pension. Because we never had such an extraordinary group of officers at the right time take a stand and say, I will not tolerate a hostile work environment. I will not tolerate getting the same benefits package that the guy who cleans the bathroom at the tribal office gets. And nothing against the guy that cleans the bathroom, anyone who wakes up and works an honest day's work is all right in my book. I just think its time that the high standard to which we are held, the inherent dangers of our job, and the highly trained skill set that we have is recognized and rewarded.

    You need do nothing other than join our ranks. You need not speak up. You need not make waves. Your union rep, the person who you elect, and negotiators from the PBA will speak on your behalf. It's time we stop allowing our chief to negotiate benefits on our behalf.. It's time we start fighting for what we want.

    Simply put. If the chief try's to get us an increased benefit and fails, he has no choice to go along with the councils decision. If he doesn't he looses his job.

    If your union rep and the PBA try to get a better benefit and the tribe is unwilling to work with us. There will be a consequence that the tribe will pay.

    Look around and see all the wonderful benefits and pensions other agencies have. They have it because years ago officers like uh took a stand.

    No wonder other agencies mock us.

    Look around and see all the riches the tribe has. They obtained those riches because they never surrender, they always are looking for a good fight.

    No winder the tribe treats us like garbage. They pay a high price for police that are scared to fight.

    It's time to change our benefits. It's time to change the perception of us.

    Things are out of control and the agency is on the verge of self collapse yet no mention as to the plan that the agency has to recruit, hire, and retain officers. We need to worry about filling our shifts before we fill the assistant chef job.

    I love the glimmer of hope that you provide to all those waiting baited breath to be the next Lieutenant, Sergeant, or Captain. You provide hope for officers to advance their career but you fall short of outlining the requirements to do so. So is this going to be a tested promotional process or are you going to just call some goon up to your office and make them a leader.

    The communication position has always been slated for a captain? I must have missed that on the organizational charts you distribute, celebrating your kingdom over the last 5 years of your reign.

    Congratulations to Captain Norton… Please join us in the union.

    Meeting with the Tribe on the Budget and the only thing you tell us you are going to pitch is a new dispatch console in BC. Do you need your captain over dispatch to justify your new console.. What a waste. All we want to hear is money and benefits. What are you going to do for me so I can take care of my family (surprisingly absent from this message).

    Well you got one thing right. (Our) efforts….often appear underappreciated by those we serve. They also are underappreciated by you. What you forgot along the way is that you are our leader but your leaderships depend on how well we receive it. Attitude is a reflection of leadership.

    I was asked via Facebook if I was going to spit a script on the message, but after reading it, I don't have the strength, so I do apologize doesn't mean I won't comment, want to say thanks to assistant chump for his dedication to the department, I mean the whole two years, hey when he was hired he told everyone he would only be here two years, I thi k that was also n the only time he told the truth since he has been here, don't worry he will give his speech at one of his three retirement parties after reciving his chiefs badge for the promotion, captain negrey, she deserves it I like her, now how we are still under budget, that's easy, having the lts force everyone to flex, or readjust or whatever it's called this week, expand the youth serves unit? Another joke, I guess there isn't enuff officer humiliated to cook dinner for the Indians, better hurry up guys they need to eat its been ten minutes, so if that gets expand are u going to promote that idiot to captain then, u know who I'm talking about the one who is so stupid she went to dr dre for a pap smear,dispatch consoles huh? Here's an idea lets hire some dispatchers first, and hell maybe even a few officers, lets start with that, appear to go underapprecsited?     I have it on good accord that our command staff and the STOF Legal Department is reassuring the Tribal Council that every single member of the Seminole Police Department can join the PBA and it still will not change the fact that the Tribe has no obligation to negotiate with them. Are they correct? Yes they are. In order to unionize as a public employee you have to be covered under Florida PERC. Sad but no one seems to have jurisdiction over labor relation for s government employees of a separate political entity sovereign nation. Is that the final answer? No. In a landmark decision, the US Court of Appeals for the District of Columbia provides case law that allows employees of tribal commerce ventures to organize unions. What does that mean? That means that employees on the business side of Tribe are eligible to join a union governed by the NLRB. SPD as government side employees are not eligible to join because Florida PERC governs us and does not recognize tribal government employees as public servant.
    So where do we go from here…..
    Indian Casino employees fought long and hard to be included in NLRB. It wasn’t until Indian gaming became so lucrative that the US congress voted to allow that Indian casino employees are eligible for the same basic rights as non-Indian employees. This was the result of private lobbying efforts aimed at leveling the playing field between Indian and non Indian ventures. After all. what would be more lucrative. General Motors building cars and having to abide by labor and wage contracts of the Automobile Workers Union or Seminole Cars being made by non union employees that have no pay scale and if they make too much money and go out on leave for 90 days they are fired.

    So can we form an independent organization? Yes. Can we all still belong to the PBA. Yes.
    You may ask how we will get funding to stand against the tribe. The answer Is too easy…. Go to their biggest competitors and the PACs that they fund.
    Multiple billion dollar gaming companies are vying for a piece of the South Florida Gamming Market. Asia, Las Vegas, and Atlantic City all want in. We get money and legal resources from them. The tribe competes with at least 3 local casinos in Broward. We get money from them. We use their money and their resources to market our newly formed organizations message. An advertisement campaign sponsored by all the Seminole Tribe Police Benevolent Association members. The consequences will be devastating. They will give us what we want. Now is not the time to cower. Now is the time to join! Please do that you will never be asked to walk a picket line or wear a bright yellow t shirt to a council meeting. We just need you to join the PBA & our business partners will take care of the rest.

    So glad I left, you people are fighting for Nothing. The Tribe does not care for you, when will you get this through your heads? They treat ALL employees of the STOF the same, you are no more special than the garbage man (and I'm sure they like him more). They do not care that you wear a vest everyday, work holidays, "raise their kids", or anything else. You mean nothing, this should be apparent by the "cuts" to benefits across the board they make every year. Thank god I used all my sick time up and left before they screwed you guys. All you dedicated employees LOL, how is that sitting with you? You can't use it, or you will get written up for excessive use of sick leave, you can't change it to vacation and after 90 days your gone. Now you want to unionize Lmfao, really an AT WILL employee wants to unionize, this will never happen just like the State Retirement or something better as we were all told. Once they find out who is the leader in this dream, of this agency ever getting a union, enjoy unemployment. In a way I feel sorry for the chief he has to talk his officers into staying for people who could care less for them, it must be trying for him everytime he makes a speach having to spill out the councils "goals", as if we never do enough. He is just lucky the economy is so bad and noone else is hiring or STOF would lose everyone, More like the Council is lucky. Really it would be cheaper for the tribe to just pay the counties they are in for LE, of course they wont get the "service" (sucking up) like they are used to but at least there will be benifits. I mean lets face it everyone who works for the tribe knows the indians hate everyone that isnt indian, and no matter what you do ie; save a life, dedicate your time (not taking care of your own family because your taking care of theirs), go above and beyond your still just a white person (or black person or hispanic) they dont care whether you Live or Die for them. if they did and they appriciated all that you do for them as LE we would have better benefits than the yard crew.
    In closing good luck with your collective bargaining, way to go with throwing your fellow officers out there (some things never change). Meanwhile I will enjoy my benefits and although I have a larger call volume and I am busy, at least when I go out of my way the public for the most part appriciates it (and shows it).
