    In August of 2010, the victim, a CCSO deputy, was solicited for input in this case. One victim impact letter was written by the deputy and read. On September 1, 2010, The Florida Parole Commission voted "NO" but the case received much discussion.

    The above inmate, Betsie Gallardo #Y42277 was considered for conditional medical release because she meets the criteria as being terminally ill. The medical staff at Department of Corrections has given her a prognosis of less than six months to live. Her release is at the discretion of the Florida Parole Commission. The Commission may decide not to release the inmate and if so she would continue to serve her sentence. Her earliest possible release date should she earn the maximum gain time, currently stands at 12/11/2013.

    Once again, this case has been placed on the January 5, 2011 voting docket for consideration for conditional medical release because the inmate’s sponsor now has developed a viable release plan for her to reside with her in Indiana and also because her condition is said to have worsened. There was an article in the South Florida Sun Sentinel dated 12/24/10 that gives some details about her condition.

    Recently, the Miami Herald did a large feature on Betsie's story and alleged horrible treatment at the hands of the state. Betsie's family and supportors have started petitions to Governor Crist to have Betsie released under medical clemency and even the religious right started trumpeting Betsie's predicament. The Department of Corrections quickly put out a statement saying they had already recommended that Betsie be released to go home and die surrounded by family members and blamed the parole board for her continued incarceration.

    The Media posts:

    "At this point, our focus needs to be on getting Betsie the nutrition she needs to continue living until that January 5th parole hearing. Betsie is bedridden and obviously not a flight risk; her cancer is stage four and inoperable." The Media posted: "a Christmas miracle for Betsie Gallardo, a young HIV+ Haitian woman dying of gallbladder cancer in a Florida prison for the crime of spitting at a police officer....Betsie's adoptive mother, a transgender woman from Indiana, wrote asking for help after finding out Betsie was unable to eat and was being refused nutrition via IV drip; she's literally being starved to death.....- slowly starved to death in a Florida prison for the crime of spitting at a police officer...."

    The Media is protraying Betsie as the "victim". Betsie was found guilty of two counts of Battery on a LEO, each carrying a maximum sentence of five years. While incarcerated, Betsie decided to BITE a female officer knowing she was infected with the AIDS virus and kick another officer. Betsie attempted to inflict the same death sentence she now faces onto another, a fellow deputy.

    The true victim, the CCSO deputy, is once again being asked for input.
