Hillsborough sheriff's deputies accused of forgery
TAMPA -- A Ruskin defense attorney accused members of the Hillsborough Sheriff's Office today of forging a judge's initials on a search warrant.
The attorney has solid evidence: An affidavit from the judge.
On May 7, Circuit Judge Chet A. Tharpe signed an affidavit stating that a search warrant authorizing detectives to search a Brandon apartment for drugs in October 2006 had been altered without his permission. The apartment number was changed in two places and the judge's initials "CAT" written in next to the changes.
But the judge said he did not make the changes.
"The handwritten alterations and initials ... are not my true initials, is not my handwriting and were not placed there by me," Tharpe said in a document filed today in open court.
Attorney Paul S. Carr is seeking to get the drug case against his client, Christopher Snipes, dismissed because of the "illegal search warrant, illegal arrest and extreme law enforcement misconduct."
Snipes, 25, remains jailed on multiple drug possession and drug trafficking charges.
One of the law enforcement officers who arrested him, Detective Ronnie Cooper, remains employed by the Sheriff's Office. But his colleague on the case, Deputy Stuart Bell, was arrested in January after internal affairs detectives concluded that he stole prescription bottles from a suspect's house, including $100 worth of the narcotic pain reliever oxycodone.
Bell was also accused of falsifying two incident reports and doctor shopping.
Assistant State Attorney Michael Sinacore said prosecutors will investigate Carr's claims about whether deputies had a valid search warrant in Snipes' case.
Carr said he is having the handwriting on the search warrant analyzed to determine which deputy made the changes. Click here to download a copy of the warrant (PDF).
"It was definitely law enforcement," he said. "Those are forgeries."
Carr added: "You cannot commit crimes to catch criminals."

Makes me wonder about Dep. Bells addiction even more.

Exactly, he didnt throw anyone under the bus because Ronnie is a hell of a detective with outstanding character. Judge Tharpe has been known to be a little forgetfull.

Tharpe is very pro-law enforcement.
Years ago, as a judge, he used to go on raids with us in order to be readily available if a secondary search warrant was needed quickly.
But........ don't embarrass him.

If Judge Tharpe said they are not his..........they are not his.
This Office is sinking to new lows. Does not matter who did it, it was done. Someone had to read the warrant hat the residence, did they both not notice the change in wording? One would think that both detectives would review the paper before filing it at the Clerks Office after it was served.
