I know Julie Bru's partner is one of our cops and I don't blame her for what Ms. Bru does, but that doesn't give her a free pass either. Bru shouldn't worry about losing her job as much as she should worry about going to jail. She has made her bed and will have to lie in it now.

Your using some very sueable words there killer. And your using them against a LAWYER. You know, LAWYER as in, I am going to sue you. I truly hope you have the evidence to back your words, cause if you don't, you better have very very deep pockets full of money.

The issue of a big payoff to former Chief Harms without Commission approval can easily be explained. The big payout for Harms was probably done in the same manner as the big payout that was going to be given to former Chief Exposito. We saw evidence of that in the form of the $200,000 check that was an initial payment of what ultimately was going to be a total of $400,000 for Exposito to quietly leave his Chief's job. This happened the way many other things happen in the City of Miami, in a very hush-hush backroom deal that few people know about and without Commission approval. Unfortunately for Mayor Regalado, Exposito thwarted his plans when he didn't accept the deal and the preliminary $200,000 check had to be voided. As you know, someone in the upper levels of the Finance Department at the MRC leaked a copy of the check to Al Crespo, who made it public in his blog. The rest of the media then ran with it. To prove my point about these deals being done in a vacuum without public knowledge, you will note that the check for Exposito was cut in January, yet the info didn't become public for several months, and only because some disgruntled City employee at a high level gave it to Crespo.

I am convinced that Harms was rewarded handsomely by the City of Miami. From what little I know of him, he would not have kept quiet all these tears otherwise.

The first time that provision was tested was in 1931, when the sitting chief, Guy Reeves was fired by the City Manager without cause and he was replaced by the Mayor's Godson (sound familiar?). The fired chief Reeves took the city of Miami to court and the courts ruled in his favor. Reeve's replacement was removed by the courts and Reeves was reinstated as Chief of Police.

Kenneth Harms had the same rights as Reeves. In Harms' case, the city in their infinite wisdom said that they did not fire Harms, and that all they had done was to demote Harms from Chief to Captain, and therefore he was not covered by the court decision. Within a couple of weeks, the City realized they were going to lose in court, so they threw a bunch of money at him. It was never publicly reported how much money he received, but it was enough for him to quietly go away.

Chief Exposito will once again test the provision in the city charter, and if I was a betting man, my money would be on him to win. He beat the city before in the 90's, and from all accounts, I am told that legally this case is stronger than the previous one. The City will be making history again.

Can't these guys get it right?

I remember Gary saying KIH was fired for demoting a staff member when told to hold off on any changes before contacting Howie. Warshaw was demoted when caught in KIH's office safe by Orlando Martinez. But all pay out over what, 5-6 grand have to be approved by the commission and the clowns at one Herald Plaza would have been all over that like stink on poop. And nothing was ever voted on or even mentioned at a commission meeting. So how was this big payout done? Please, explain.

9 figures like $100,000,000 ? HAHAHAHAHAHA. During his time, the city charter said dept. heads served at the pleasure of the city manager. There was no appeal process. So how tell me could he sue? Another thing is that during that time when he retired, it wasn't based on his Chief's pay. He retired as a Captain of Police. He might Or might not have retired at chief's rank pay. And I don't give a poop. But 9 figures? It would have made the media big time, and nothing was ever mentioned about a hundred million payoff dufus. What they have always won, was when someone was demoted by a chief from major to their civil service rank and sued. Court have always said you serve as command staff at the will of the chief of police as stated in the city charter. But really, Harms got 100 million. LOL

The City rarely if ever wins. Add mayor Regatardo , johnnie "the door Mat" Martinez and "I'll do anything you say" Julie bru and your chances of winning have to be slim to none.

Are you saying the city's chances are slim or the person suing? But the poster is correct. The only time they win is when demoted have sued and lost. Not many have as lawyers tell them forgetabountit. One got a settlement for age discrimination as the chief told him he was too old. But the rest, the clowns at MRC have won those every time.
