Read FS. 934.02. It gives the definition of oral communication. Excluded are conversations where there is no expectation of privacy.


Then the controlling case law for Florida, Smith vs. City of Cumming, 11th US court of appeals
"The first amenedment protects the rights of citizens to gather information about what public officials do on public property, specifically the right to record".

Every case that has made it to court for recording police in open public to my knowledge has been struck down. Also there are several other federal circuits who have explicitly ruled on this, but they are not controlling for Florida. The Glick case was in boston, and the illinois law which was suppoedly the harshest was also struck down, and there has been at least one other circuit who has ruled on this.
