BROOKSVILLE - A sheriff's lieutenant opted to resign on Friday instead of facing criminal charges for accepting pay for hours he didn't work.
The State Attorney's Office completed its investigation into Robert Libengood last week with the option of charging him with grand theft and/or official misconduct. Libengood claimed 10 days of work, worth about $3,000 on his time cards, but did not physically work those hours, according to Assistant State Attorney Phil Hanson.
The purpose of the investigation was to determine whether it was "something done intentionally or negligently," Hanson said.
When Libengood submitted his resignation Friday, Hanson decided it was "appropriate" to drop the pending charges.
A copy of Libengood's resignation letter was unavailable Monday.
Sheriff Richard Nugent said the decision not to prosecute was entirely up to the State Attorney's Office.
He called the decision "very unusual," but added that the sheriff's office "didn't have any say in it. We were told that's what they were going to do."
Nugent explained that the days off were interspersed among approved time off that was spread out over nine months. Libengood was going through a tough time personally, so his supervisors initially didn't catch on to what was happening, Nugent said.
But the "checks and balances" system eventually caught up with Libengood and his superiors began investigating.
The sheriff said he denied Libengood's request for a payout of accrued sick time at the time of his resignation.
Hanson repeated that the lieutenant was going through a tough period in his life at the time of the alleged crime, and it was possible Libengood was "distracted." He added that Libengood had accrued the hours he took off, but he failed to officially document that he was using them.

BROOKSVILLE — The human resources manager at the Hernando County Sheriff's Office has resigned after it was revealed she had failed to conduct the agency's random drug-screening tests for employees for almost two years.
Christine Libengood, 36, who had worked at the Sheriff's Office since 1995, gave notice of her resignation March 18. She had been manager of the human resources department since 2001.

The 22-month lapse in employee drug testing was uncovered when a deputy resigned March 6 after admitting to superiors that he had recently smoked marijuana. Deputy Patrick Craven had been involved in a car crash that day and was given a drug test, which is Sheriff's Office policy.

When advised that a second drug test would be given, Craven declined to take the test and immediately quit the force. There was no indication that Craven was impaired at the time of the crash or during the investigation.

Later, Sheriff Richard Nugent asked Libengood to produce a list of employees who had been tested; policy requires a minimum of 10 percent and a maximum of 25 percent of "safety-sensitive" employees be randomly tested during a fiscal year. Libengood told Nugent that she couldn't come up with a list, sheriff's spokeswoman Donna Black said.

"She couldn't produce one because she hadn't been doing them," Black said Monday.

Black said the department has reviewed the policy and already taken measures to make sure there are no more lapses. She also said supervisors who had concerns about particular employees have always had the ability to conduct random tests.

"We were safeguarded beyond random drug testing," Black said. "Our agency goes above and beyond taking effective measures to make sure the public is safe."

Libengood couldn't be immediately reached for comment.

Libengood is a good example of another benefit we get. Do a crime and all you have to do is resign. No charges will be filed, as was the case with him. Steals and he gets away with it, unlike other government employees in the county (Anderson, a good example). We get excuses made for us ! :devil: :devil:

Anyone here from any of them?I wonder if the agency blackballed them.Its amazing that Christine thought she ran the ship until she got a huge hole in the bow!!I feel she got what she deserved. :evil:

I haven't heard from them but I have heard that the drug tests that are being used are easy to pass....as has been done by those involved in fender benders who are on pain meds and tested....she didn't get what she deserved, she deserved more then what she got like getting fired instead of being allowed to resign. Now that would have left a mark that was deserved. The problem with the agency is too many related people working together and if they aren't related there are too many having intimate relations with each other while married to somone else!!!

They were sent packing on a cruise to nowhere with pink slips in hand.Then the door was slammed as Nugent said"dont let the door hit ya,where the lord split ya".Starange the way the man upstairs works.Christine so well deserved this that I was ecstatic over her departure!!!! :snicker: :snicker: :snicker:

If anyone in the whole agency deserved to be canned,it was Christine Libengood.She was one of the sole source of gossip and drama at the agency.Funny thing was that she got the biggest knife in the back and then back through her stomach about 58 times.hahahahahahahahahahah

The agency is way better without this type of nepotism going on.This is a work place not a soap opera!!!!Make a policy beavis and butthead.Clean out these husband and wife deals.

They will not go forward with the fraternization policy until at least September. Why you ask? Well that is when the second in command retires. He doesn't want the policy to effect him spending time with his Bio-Girl.
