Haines City Police Captain Indicted, Chief Resigns

BARTOW | A grand jury Thursday indicted Haines City police Capt. Mervin Stewart on two counts of perjury, and police Chief Morris West has resigned in return for unrelated prostitution charges being dropped against him.

Stewart, the second in command of the department, faces two felony counts of perjury stemming from investigations into sexual conduct with two police officers under his command.

West resigned his position and relinquished his police credentials in an Oct. 31 settlement with the State Attorney’s Office, according to a grand jury report released Thursday. His resignation was not made public until Thursday.

In return, the state attorney dropped an Oct. 24 indictment on three misdemeanor counts of soliciting prostitution.

Polk County sheriff’s Maj. Larry “Mike” Pruitt was appointed acting police chief after West was suspended on the day of his indictment.

Pruitt suspended Stewart, 43, with pay, from his $57,995-a-year job on Nov. 7.

Stewart was arrested in Haines City on Thursday, shortly after the State Attorney’s Office released the indictment charging him with two counts of perjury in an official proceeding. Both counts were based on the captain’s Nov. 6 testimony before a grand jury investigating the police department.

Escorted by a Polk County sheriff’s deputy and wearing a Haines City High School Hornet’s T-shirt, shorts and handcuffs, Stewart was asked what he thought about the charges against him.

“They’re racially motivated, and I’ll prove it in court,” he replied.

He was released from the Polk County jail Thursday night on $50,000 bail.

PERJURY CHARGES

In the first count against him, Stewart is charged with lying about a sexual harassment complaint filed by Haines City police Officer Nicole Gusaeff over an April 12 incident at a Winter Haven bar in which she said he put his arm around her shoulders and groped her, the indictment states.

He told the grand jury he didn’t inappropriately touch her or sexually harass her.

In the second count, he is accused of lying to the grand jury when he denied he told two other Haines City officers, Cpl. Terry Giffin and Sgt. Thomas Grant, that he had a sexual relationship with police Cpl. Emelynda Hernandez, who also was suspended Nov. 7.

Hernandez resigned Monday.

State Attorney Jerry Hill said the Stewart and West indictments conclude the grand jury’s investigation, which began in August.

Gusaeff filed her sexual harassment complaint Aug. 23.

She alleged Stewart engaged in repeated sexual comments and actions that began one week after Feb. 18, when he was promoted from a patrol sergeant to captain, bypassing the rank of lieutenant.

Gusaeff complained there were incidents at the Policeman’s Ball at a Winter Haven hotel and a subsequent gathering of Haines City officers at Tanner’s Pub in downtown Winter Haven, according to Haines City records and a Winter Have Police report.

At the pub, Gusaeff’s complaint states, Stewart “pulled me to an empty corner and stated that he wanted to touch me in a sexual manner, and he started closing in on me from behind.”

She charged he touched her left breast and buttocks.

Gusaeff detailed several other incidents over the following weeks in which Stewart would call her on her cell phone to ask her out for drinks or a date, the complaint states.

On two occasions, Stewart offered to “pat me down,” Gusaeff charged.

Gusaeff said she reported several incidents to other officers, and they became well known around the department.

She said she filed the sexual harassment complaint because “at that point I felt that I was being targeted by Capt. Stewart because of the past incidents.”

City Manager Ann Toney-Deal investigated Gusaeff’s complaint and told The Ledger she could not sustain the allegations.

The second perjury count against Stewart stems from an April 19, 2006, incident and subsequent internal affairs investigation.

In that incident, Stewart’s wife at the time, Cpl. Angela Stewart, reported he had been missing for 24 hours, and she could not locate him after contacting friends and family.

The city destroyed the official internal affairs report, but acting Chief Pruitt on Wednesday released an unofficial copy of it to The Ledger.

After learning of Angela Stewart’s report, West found Mervin Stewart’s truck parked outside Hernandez’s Poinciana home, the report said.

Sgt. James Babers and Lt. Michael Green then interviewed Hernandez, according to the report, and she gave conflicting accounts of the incident but denied any sexual relationship with Stewart or that he had stayed the night.

Hernandez and Stewart told investigators he had dropped some fruit off to her after her recent release from the hospital.

Some neighbors of Hernandez, however, told investigators they’d seen Stewart at Hernandez’s home once or twice a week for the past several months, the report said.

His visits lasted for eight to 10 hours, they said.

The internal affairs investigative report did not sustain charges of untruthfulness in an official proceeding against Stewart and Hernandez. Chief West approved the report.

ALLEGATIONS AGAINST WEST

In the police chief’s case, West’s indictment accused him of soliciting prostitution from Kimberly Latrice Willis Ambrose, 31, of Haines City last year.

The first incident is supposed to have occurred Nov. 22, 2007, while subsequent incidents allegedly occurred between Nov. 23, 2007, and Dec. 10, 2007, and between Dec. 11, 2007, and Dec. 25, 2007, the indictment states.

All three counts charge that West, who is married, solicited Ambrose for prostitution, purchased her services, entered a building for the purpose of prostitution or aided and abetted in those acts.

Ambrose has a lengthy arrest record, mostly involving theft charges, according to court, jail and prison information.

Records show Ambrose was serving a sentence on a probation violation between Oct. 10 and Dec. 7 — the time period of two of the alleged prostitution incidents involving West. That sentence required her to do work at the Haines City Parks and Recreation Department, but she spent no time in jail, said Sheriff’s spokeswoman Carrie Eleazer.

West is the brother of Haines City Commissioner Horace West.

OFFICERS RECEIVED HIGH MARKS, PROMOTIONS

According to his personnel file, West is a Haines City native who joined the Police Department in December 1986 as a patrol officer after working for three years at the Polk County Correctional Institution, a state prison.

He graduated from Haines City High School in 1979 and from Bethune Cookman College with a degree in criminology in 1983.

He got regular promotions at the Police Department and became chief in July 2003, succeeding retired Chief Tom Wheeler. The chief is paid $74,694 a year.

After suspending West, Toney-Deal bypassed Stewart and hired Pruitt on a 30-day contract to manage the department. She said she would re-evaluate the contract before it expires.

Stewart, who also is a Haines City native, joined the Police Department in March 1991 after completing the criminal justice program at Polk Community College, according to his personnel file.

He received positive evaluations during his career while working as a patrol officer, detective, on the narcotics squad and as a school officer.

Stewart was He had received “outstanding” evaluations, the highest grade, for the past two years.

In February, West promoted Stewart, who was a sergeant at the time, to captain over the heads of the department’s lieutenants.

He went from overseeing the Crime Reduction Unit to being second in command in the department.

West promoted him despite the fact that the department’s review board, comprised of outside law enforcement officers, did not include him on the list of recommended candidates.

At the time, West said he reconsidered the internal candidates because he did not want to hire anyone on the board’s short list.

Now Staff 1 will have somewhere to apply once Felicia Wilson is re-instated as Sgt., Al Wilson is paid back the suspension pay because Staff 1 took too long to make a decision about discipline, and an internal department riot erupts. :devil: I stand in absolute AMAZEMENT at the shady dealings this place has to offer!!!! Attention: For those of you not already abiding by this new SOP directive (which you'll have to digitally sign after reading .....remember it's timed how long you keep the SOP window open).........find a large oak tree and plant your azz under it (G.O. 1234 I don't give a f*ck anymore (3a). ) And remember, lying under oath, shady dealings, and stealing from your brother officers is OK at LPD, but for God's sake........stay out of the polling places!!!!!!! You could be charged with a misdemeanor for walking into the courthouse during an election!!!!! (According to Lord Mallory. ) We had quite a nice intermission from his law interpretation emails there for a while.........what happened? Anyway, I though the JUDICIAL branch interpreted law, not the EXECUTIVE branch, is Lord Mallory not a member of the executive branch? Why do we constantly hear these "FLORIDA LAW ACCORDING TO MALLORY" speeches? Will just any lawyer do for departmental FL statute interpretation? I can list a few defense attorneys who will tell you that stopping a vehicle for having a tag which when run reveals the vehicle is stolen is an "absolute violation of my client's 4th amendment right against unreasonable siezures." People: 10-65, 10-65, 10-65......and nothing more. There is NO reason to do more. There is no support from our City when we go above and beyond, NO support from our administration when we have frivilous complaints lodged against us, NO division between right and wrong established by our chief when two 'minority' officers throw off their code of ethics and act as do their ignorant brothers and sisters in our NW community. If you think you are getting ahead with all this "I'll be out with a 13P at....." stuff you are sorely mistaken. Just do your job...........10-65 the calls that pop up on your screen.

Where is our relief? Why can't we get a Grand Jury to look into our F*#@%* UP administration. Oh, that's right, it is because Hill and Boatner are continually covering for each other. It's like the world series of poker. "I'll see your Arley Smith and raise you an Al and Felicia Wilson". What is so sad is that they have gotten away with it for so long that they do it blatantly and act smug and arrogant about it. There are alot of skeletons in those closets. When reading the part of the article about the grand jury's findings on the state of morale for the HC officers I could have sworn they were talking about Lakeland. And Dougie Boy you need to take notice of what they said about the city manager. You will not be afforded the same luxery because you are aware of the problems with the Boat. All the recent bad press and inconsistent discipline practices along with an overwhelming vote of NO CONFIDENCE. It's time you take action before you're the one looking like a STOOGE on the front page trying to sell that you did not understand the magnitude of the problems at the PD.

AMEN!!!!!!! I 10-65 that all day long. There is no reason to go above and beyond anymore. This decisions of this administration have demoralized a once great department and the people who helped make it that way. The officers who do the right thing but have medical issues are kicked to the door while those with no ethics or morals continue to progress up the chain of command. Disgusting to say the least!!!! And isn't the former and (soon to be again) SGT F. Wilson the same one that would show up to training and briefings with her bible? Can someone please tell where in the bible it is written that it is okay to steal and lie to your fellow brethren and sisters in an already difficult job! How about a vote of no confidence for her when she returns to work wearing stripes!

What do we need to do to get a decent media outlet to listen to us and tell the public what is going on? I would think a corrupt chief of police, racial favoritism, felons in the position of power and a "look the other way" city manager would be a newspaper's dream.

What will we do when idiot Wilson is re-instated as sgt? Probably not much since we have no power to stop this stupidity. Her and her co-felon husband did nothing but help to destroy this dept. Neither of them were qualified to be promoted, yet when it looked like he would die on the promotional vine, positions were created so he would be promoted. Then other, much more experienced and qualified members were passed over so he could be sent to the FBI Academy. He may try to paint himself as the good guy victim in this, but he has played the race card more tham anyone else at LPD to get what he wants. And yes, he did refer to himself as a victim in his internal investigation. I would suggest that we not only 10-65 the calls that are sent to us, but that all decent cops distance themselves from all known LPD felons.

You obviously have no concept of what the union is here for. If you were accused of some policy violation and were disciplined and decided that you wanted to grieve it..........you would expect your PBA rep to be there by your side. You'd probably feel like you had been done dirty by the administration and many other people may share your belief. It may be a GREAT thing to grieve. Problem is, no matter if your right or wrong, the PBA is there to represent and assist you. Just like defense attorneys defend some of these yahoos who are guilty as hell, they still deserve representation. We pay for it and expect the PBA to represent us if the time comes. I know the Wilsons are guilty as sin and I have lost every ounce of respect I ever had for either one of them but don't throw this back on the PBA. That's wrong. They are here to represent each and every one of us whether the majority of us believe that the administration was right or wrong in any disciplinary decision made. I don't like thinking that my dues are going toward the defense of two worthless POS's anymore than you. Simple fact of the matter is though, they deserve the same representation you or I do, why? They are card carrying members of the PBA, that's why. For once I can say with confidence I think the majority of us are hoping the PBA loses their fight, and the City wins......as bad as that sounds.

I'm afraid he's right. The PBA can't chose who to represent and who to deny. These two pieces of trash are dues paying members, so they have to have union representation. Plus the fact that I wouldn't put it past Boatner to delay making a decision so the two lying felons would have a way out.

To the good officers at LPD, keep your heads up, hopefully, soon, it will be your turn to bring the morale up in your department and get your day.

Unfortunately, that I see, you are stuck more in the good ol' boy system then any other department and that's sad. When I got hired with my department back in the 90s, we had MANY bail to LPD because that was THE place to be (pay, benefits, commrodery (SIC). But because of that system coinciding with the 'we need to promote demographics' so no one will sue us for not promoting their ethnicity has ruined your police department and is slowly deteriorating all agencies and companies.

But my opinion is, agencies, especially government, are scrutinized because they do not promote enough 'demographics' or 'affirmative actions'. I do not feel that this is right. I believe that if a person earned and worked their way to that position, I dont care if they are black, white, hispanic, male, female, or even transgendered... as long as they KNOW their job and can proficiently do their job, I have confidence in them and would work beside them anyday in any type of scenario.

I have also come to the conclusion after reading the turmoil in LPD and HCPD (in newspapers) that when something goes wrong with the demographics and affirmative actions that are placed in a role of a supervisory position solely because on race or gender and they are caught in a criminal/ violation of procedure, the first thing they yell is 'race card' or they are picking on me because I'm..... (lesbian, gay, female, colored, or whatever) and their demographic handicap (NAACP, ACLU, Uhurus, etc) comes running. I have also seen that the ones that did wrong and KNOW they did wrong, you never hear them again and those groups do not come running to defend them. The newspapers do not publize it and the justice of the punishment is swiftly taken.

I'm not in a union, nor do I care to. But I've learned through my family and friends who are currently and who were in unions that no matter how wrong the actions of one person did, if they are part of the union, the union has no choice but to represent them and find errors to get them free of their own wrong doings.

I dont know too much about unions and correct me if I'm wrong, but arent unions a group of officers/people who make sure that the department creates equality among rank, decent working conditions and to prevent superior officers from placing targets on lower level officers backs because just to screw with them, while another officer who does the same thing, they dismiss because they do not have the grudge with that person?

The department actually gave a lessen sentence then I agree with on what the Wilson's committed. Here I say what they committed and not what they were accused of. It was theft, and if it was Joe Blow at his company, charges would have been filed.

The department can say, due to the sensitivity of this case (due to race) we wanted to make sure that we had everything in pecking order to justify our decision, which is why it took a little bit longer. Maybe they can say that they would have had it wrapped up within the 180 days but due to finding more and more evidence, it lasted longer then expected.

In this case, and I know the Union isnt to thrilled about it, they are the defense vs the state. Just look at it this way (union), you are trying to let off a child molester or murderer based on a small technicality. You know they are wrong, but yet you still try to find a way to get them released from their charges. Granted they didnt commit these heinous crimes, but if you look at this way, a crime is a crime, no matter how severe it is.

Polk County S.O. had a black Sgt a few years ago, who committed the same thing as this couple and he was subsequently fired and charged. Polk County S.O. had a hispanic deputy who stole, he was subsequently fired and charged. How come this couple was different? These deputies were of ethnic minority, same as yours. This lessens the morale of any officer or deputy working the streets and definately the upper staff lose their confidence in their officers to uphold the law, ethnics, morals, and codes that we are all sworn to go by, utilize, and enforce.

I read the Grand Jury's finding about Chief West and Capt Stewart.. and I was like 'wow'. I was even more astonished when he said this was all because he was black.. what book does he read? Apparently not the same Florida State Statute that you or I read.

But at the end of my soap box, all intelligent citizens know that there are some very good, fine officers in your department as their are in every agency. Unfortunately, that doesnt sell as much as corrupt officers to the news media. I have met some very good officers through working environment, classes, etc, and would love to have them back me up on any day, on any scenario. Keep your heads up, your 'justice' will come.

Just a reminder you can steal, lie, cheat, use the meditation room for a tryst and destroy evidence. I could go on an on but i would need 30 pages. DO NOT GET SICK OR HURT! You will be gone so fast you will not know what hit you. This applies to every Dept. member except the Commander of Charts. The American's w/ Disabilities Act does not apply here. So when your 10-65ing don't injure yourself and if you do start packing. Cause you think this other nonsense is unreal you aint seen nothing yet! A few of our fellow officers who just worked and did not cause problems can back me up on this one. Look both ways when you cross the street. Unless you call the third floor home, been nice to know you. There are a couple of us that I have not forgotten and wont. Wow this place is very sad my fellow LEO'S. Good luck and lay low!
