Bailiff forgets to pick up shackled prisoner

PUNTA GORDA — A Charlotte County Sheriff's bailiff has been reprimanded after leaving a shackled prisoner overnight at the Justice Center last week.
Cieric J. Walton, 28, faced County Judge Peter Bell in court Thursday for a plea and sentencing hearing. He had been charged with driving knowingly with a suspended or revoked license and was being held on a bench warrant after failing to appear for a court date in April.
Bell sentenced Walton to 10 days in jail and credit for time served.
But according to a Charlotte County Sheriff’s report, Walton never returned to the county jail. Before the hearing, Deputy Jerome Libby — no relation to Sheriff’s Maj. Dan Libby — escorted Walton, who was wearing handcuffs attached with a chain running down to ankle shackles, to the locked holding cell for courtroom 3B. After dropping off Walton, Libby left the Justice Center and returned to the Sheriff’s Office.
Returning to the Justice Center Friday, deputies discovered Walton still sitting in the holding cell in cuffs and shackles. The holding cells at the courthouse do have bathroom facilities. After he was discovered in the holding cell, Walton was immediately taken back to jail and fed, the report stated. No internal sheriff’s investigation was deemed necessary.
Jennifer Scott, courts administrator, cited Libby with “neglect of duty,” which includes inattention to duties or procedures.
